Your access to and use of eyecontemporaryart.com (‘the Website’) is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.
2 – Privacy Policy
We are committed to responsible data management and subscribe to the principals of the data protection legislation in Hong Kong. The information provided by you is not available for sale or use by third parties. We use Google Analytics to collect information about how our visitors use and navigate this website. We use this information to analyse usage of the website. The cookies collect information such as the number of visitors to the site, which pages they visited and whereabouts they came to the site from. This information is anonymous and cannot be used to identify you personally.

You agree to indemnify and hold eyecontemporaryart.com harmless from and against any breach by you of these Terms and Conditions and any claim or demand brought against eyecontemporaryart.com by any third party arising out of your use of the Website and/or any Content submitted, posted or transmitted through the Website, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by eyecontemporaryart.com in consequence of your breach of these Terms and Conditions.
7 – Disclaimers and Limitation of Liability
Use of the Website is at your own risk. The Website is provided on an ‘AS IS’ and ‘AS AVAILABLE’ basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. eyecontemporaryart.com reserves the right to refuse or remove images or text posted on the Website.
8 – Artwork Return/Refund Policy
The Buyer has a period of 3 days from the delivery of the artwork to use his/her right of withdrawal with Eye Contemporary Art. Changes and returns are accepted on condition that the artwork has not been damaged and returned in its original package. Once we confirmed the good condition, we shall process the refund within 30 days.
The refund applies to the final net price of the artwork paid by the Buyer. A restocking fee of 15% of the item final net price applies. Buyer is responsible for return shipping charges and will not be reimbursed for the original shipping cost. Any international customs duties and taxes will not be refunded. The amount owed will be refunded to Buyer’s original source of payment in the same currency and using the same exchange rate as per the original order (minus shipping/insurance costs, restocking fee and international customs fees, if any) .
For Salvador Dali bronze sculptures we will accept return only if the artwork delivered is proven to be defective or broken. In this case we will replace it with another one or repair it. We will pay for all related shipping costs and customs duty (if any). There won’t be a refund option for Dali sculpture sales.
9 – Artwork Reservation Policy
Eye Contemporary Art is able to hold artworks for client with a non-refundable deposit. A 20% deposit (or any mutually-agreed amount) will secure the work and full payment is then expected in 3 days.
If client is unable to pay within this time frame without notifying the gallery, the deposit will be non-refundable and held as a credit for future purchases.
10 – Governing Law
These Terms and Conditions shall be governed by and construed on accordance with the law of Hong Kong and you hereby submit to the exclusive jurisdiction of the Hong Kong courts.
